Moroccanoil Rewards Loyalty Program Terms and Conditions
These terms and conditions (the “Loyalty Membership T&Cs”) govern your participation in, and membership of, the Moroccanoil Rewards Loyalty Program (“Program”). Participants in the Program are subject to the terms and conditions herein.
Your participation in the Program is subject to your compliance with these Loyalty Membership T&Cs (as may be amended in accordance with the terms of these Loyalty Membership T&Cs). By enrolling into the Program, you (“you” or “Member”) agree: (i) that you have read, understand and agree to be bound by these Loyalty Membership T&Cs, including Moroccanoil’s Terms of Use, which are incorporated herein by reference; and (ii) to comply with all applicable laws and regulations relevant to the Program. Your personal data will be handled in accordance with our Privacy Policy. If you do not agree with the terms of these Loyalty Membership T&Cs, please do not become a member of the Program (or terminate your membership of the Program if you have already joined).
These Loyalty Membership T&Cs are not intended to impact your statutory rights, and any provision of these Loyalty Membership T&Cs which conflicts with your statutory rights is void.
These Loyalty Membership T&Cs do not affect in any way: (i) any other sets of our terms and conditions you have agreed to in relation to other services or benefits; or (ii) any other agreement you may have with us.
a. ELIGBILITY FOR MEMBERSHIP:

The Program is operated by Moroccanoil Israel Ltd. (Company number: 514031053) whose registered office is at 1 Moshe Levi Street, Rishon LeZion 7565815, Israel (“Moroccanoil” or “we”). The Program is offered at the sole discretion of Moroccanoil or its affiliates or subsidiaries.

Membership of the Program is open to individuals who are at least 18 years old.

Membership in the Program is voluntary. No payment of any kind is necessary in order to enroll in the Program.

The Program is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations, businesses, traders or other groups may not enroll in the Program.

Employees of Moroccanoil and their immediate family members are not eligible to enroll in the Program.

Moroccanoil reserves the right to limit the number of members in the Program at its sole discretion at any time.
b. MEMBERSHIP ENROLLMENT:

Eligible individuals may enroll in the Program by visiting https://uk.moroccanoil.com/pages/rewards (the “Site”), creating an account, and joining the Program.

In order to enroll, you may be required to create a password and provide your full name, telephone number, postal address, email address and other personal information.

Once you have provided this information, you will be enrolled in the Program and provided with a Member account. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. You are responsible for ensuring that your password remains secret and for notifying us if you become aware your account is being used by a third party. We will endeavor to suspend an account on being made aware of unauthorized use, but we will be unable to return any Points redeemed from your account by a third party.

Only one Member account may be associated with a single email address. In the event of a dispute over ownership of a Member account, the Member will be deemed to be the authorized account holder of the email address submitted at the time of enrollment.

For purposes of these Loyalty Membership T&Cs, the “authorized account holder” is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
c. MEMBERSHIP WITHDRAWAL:
You have a right to withdraw from the Program at any time. To do so, please email Moroccanoil Customer Experience at contactus@moroccanoil.com.
d. HOW TO EARN POINTS AND LOYALTY TIERS:

The Program is a rewards program that benefits its Members with points every time they make a purchase on the Site. You can earn points (“Points”) for Great British Pound ("Pounds") you spend on the Site (such purchases, subject to the exclusions set out below, being “Qualifying Purchase(s)").

You cannot earn Points on: (i) Pounds spent on promotional value items, taxes, shipping charges; or (ii) purchases involving employee discounts, commercial account purchases, charitable donations, merchandise credits or any other Rewards (as defined below) or awards. You will earn one Point for each Pound spent on Qualifying Purchases, calculated on a whole-pound basis only, with any fractional amounts rounded down (for example, a Qualifying Purchase of £3.50 will earn 3 Points).

For your purchase to qualify to earn Points, you must: (i) be signed into your Member account at the time of purchase; or (ii) provide your Program member identification (that is, the email address you registered with under the Program) when making a purchase.

If you return items from a Qualifying Purchase, the Points you earned when you bought that returned item will be automatically deducted from your account balance.

Moroccanoil may also, from time to time, at its sole discretion, provide additional Points in connection with certain actions, transactions and promotions.

If you earn a certain number of Points, you may be eligible to reach a certain loyalty tier. There are three loyalty tiers based on the number of Points you hold: Original (1 – 149 Points), Icon (150 – 399 Points), and Gold (400 or more Points). If you reach a loyalty tier, you may be eligible for certain Rewards only available to that tier.

Information on: (i) Qualifying Purchases; (ii) opportunities to earn Points; and (iii) reaching Program loyalty tiers will be posted on the Site and may be published through other media (for example, in marketing communications and social media). Visit our FAQs to learn more about these topics.
e. RESTRICTIONS ON POINTS:

Points have no cash value, are non-negotiable, and cannot be redeemed either in whole or in part for cash.

Only the Member paying for products in a Qualifying Purchase will qualify for Points.

Points do not constitute property of any Member or other person and may not be brokered, bartered, pledged, gifted, sold or otherwise transferred for consideration, other than by Moroccanoil or as expressly provided for in these Loyalty Membership T&Cs.

Any receipt or use of Points in violation of these Loyalty Membership T&Cs will render such Points void.

Neither Member accounts nor Rewards or Points may be shared or combined.
f. REWARDS:

Points can be redeemed for benefits and rewards ("Rewards"). Rewards might (but are not guaranteed to include) free gifts with purchase, free shipping or birthday rewards.

From time to time, the number of Points required to earn a Reward will be updated in the Program. Please check your Member account details for the most up-to-date Point requirements.

Any Reward may change from time to time and may be offered on a limited basis only. The number of Points necessary to earn a Reward is determined by Moroccanoil in its sole discretion.
g. REDEMPTION:

Points earned are not eligible for redemption until 72 hours after they have been awarded. Points can only be used once, and only when the Points are showing in your account.

Points cannot be combined with any other type of coupon or Moroccanoil promotion or award.

AFTER A MEMBER’S ACCOUNT HAS BEEN INACTIVE FOR 12 MONTHS, ANY POINTS IN THAT ACCOUNT WILL EXPIRE AND CANNOT BE REDEEMED. A Member will be deemed inactive for any period in which a Member earns no Points and redeems no Points. Where a Member’s Points are approaching expiry, we will send the Member an advance notification by email prior to the expiry of such Points.

You may view how many Points you have accumulated by signing into your online Moroccanoil account/Member account and visiting your account details.

You may redeem Points by accessing your account on the Site and selecting the available Points redemption option at checkout, where the number of Points available to you will be displayed. Points redeemed for a Reward or discount at checkout will be immediately deducted from the total Points balance available in your Member account.

We reserve the right to change Rewards, how you earn Points and reach each Program tier and how we evaluate and reward your Qualifying Purchases and other Program activity. We reserve the right to place limits on: (i) the number of purchases or activities that are eligible to earn Points or reach any given tier; and/or (ii) the number or types of Rewards you may receive or earn in any given tier, any given time period or for the duration of the Program.

Points can only be redeemed for Rewards or discounts on the Site, unless otherwise expressly authorized by Moroccanoil. To redeem Points or Rewards you must make a Qualifying Purchase (i.e. a Qualifying Purchase is required to earn Points and to redeem Points respectively). Your ability to redeem Points is subject to product availability at the time of redemption.

Neither Points nor Rewards cannot be exchanged or returned for another product or service or a monetary refund.

The products available through the Program are for your personal use only. You may not sell or resell any of the products you purchase or otherwise receive from us through the Program. We reserve the right, without notice, to cancel or reduce the quantity of any order to be fulfilled, or any products to be provided to you, that we reasonably believe (with such belief being based on robust evidence) may result in a violation of these Loyalty Membership T&Cs.
h. COMMUNICATION:
As a Member, you: (i) will be sent administrative emails from Moroccanoil; and (ii) may choose to receive marketing emails from Moroccanoil about the Program. You may opt-out of the marketing emails at any time, but administrative emails will still be sent to you as they relate to your membership of the Program.
i. ADMINISTRATION OF THE PROGRAM:

You must use the Program solely for its intended purpose and must not use the Program for the benefit of any third party.

Any abuse of the Program, failure to follow any terms of these Loyalty Membership T&Cs or any misrepresentation by a Member may result in that Member's membership of the Program being revoked.

Moroccanoil reserves the right to seek all remedies available in the event a Member defrauds or abuses the Program, fails to follow any terms of these Loyalty Membership T&Cs or makes any misrepresentation to Moroccanoil.

Program purchases, as reflected in Moroccanoil records, shall be deemed correct and final. Moroccanoil reserves the right to determine a Member's entitlement to Points and/or Rewards based on Moroccanoil records and calculation of account information.

Moroccanoil is not responsible for communications, Points or Rewards which are lost due to an inaccuracy in or change of a Member's address or other contact information.
j. TERMINATION:

The Program has no expiry date and may continue until such time as Moroccanoil, at its sole discretion, elects to end the Program. We reserve the right to terminate, suspend, modify or restrict any aspect (or the whole) of the Program at any time at our sole discretion. Any and all Points that have not been redeemed as and when the Program is terminated shall become void. We will give Members 30 days’ notice prior to any significant changes to the Program becoming effective.

Moroccanoil reserves the right to cancel a Member’s account: (i) (after giving you reasonable advance notice) after one year of account inactivity; or (ii) without notice if Points were obtained through that account as a result of your fraudulent activity or your breach these Loyalty Membership T&Cs. If you received Points due to technical failures of any kind, Moroccanoil reserves the right to deduct from your account balance any Points which were not properly earned. If your account has been cancelled and you would like to reactivate it, please notify Moroccanoil at contactus@moroccanoil.com. Moroccanoil has no obligation to reactivate your account if the account was deactivated due to breach of these Loyalty Membership T&Cs or fraudulent activity.

No extensions, cash refunds or other exchanges will be allowed for Points that have been removed from a Member's account based on inactivity.

If you want to cancel your enrollment in the Program you must notify Moroccanoil at contactus@moroccanoil.com.

All accrued Points will be lost if your Member account is cancelled, and you will not be able to redeem any remaining Points.
k. LIMITATION OF LIABILITY AND ADDITIONAL TERMS:

THE MEMBER AGREES THAT MOROCCANOIL AND ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR:
-
ANY LOSS WHICH: (A) WAS NOT OBVIOUS THAT IT WOULD HAPPEN AND NOTHING YOU SAID TO US BEFORE YOU ENROLLED IN THE PROGRAM MEANT WE SHOULD HAVE EXPECTED IT (SO, IN THE LAW, THE LOSS WAS UNFORESEEABLE); OR (B) WAS SOMETHING YOU COULD HAVE AVOIDED BY TAKING REASONABLE ACTION;

LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITY;
-
THEFT OR UNAUTHORIZED REDEMPTION OF POINTS OR REWARDS, OR USE OF A REWARD, CAUSED BY CIRCUMSTANCES BEYOND THE REASONABLE CONTROL OF THE RELEASED PARTIES; OR
-
ANY ACTS OR OMISSIONS OF THIRD PARTIES WHICH THE RELEASED PARTIES DO NOT HAVE A RELATIONSHIP WITH.

WE RESERVE THE RIGHT TO CORRECT, WITHOUT NOTICE, ANY ERRORS IN THE PROGRAM.

IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU FOR ANY DELAY IN OR FAILURE TO PERFORM OUR OBLIGATIONS UNDER THESE LOYALTY MEMBERSHIP T&CS WHICH IS SOLELY AND DIRECTLY DUE TO CAUSES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, ACT OF WAR, NATURAL DISASTER OR TERRORISM.

NOTHING IN THESE LOYALTY MEMBERSHIP T&CS SHALL LIMIT MOROCCANOIL’S LIABILITY IN RESPECT OF DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE, OR IN ANY OTHER WAY THAT IS PROHIBITED UNDER APPLICABLE LAWS.

THIS SECTION WILL SURVIVE TERMINATION OF THE MEMBER’S ENROLLMENT IN THE PROGRAM.
l. MISCELLANEOUS:

We reserve the right to amend these Loyalty Membership T&Cs at any time at our sole discretion. Any changes we make to these Loyalty Membership T&Cs will be effective immediately on posting to the Site. You should review these Loyalty Membership T&Cs and check the Site frequently to ensure you understand the terms and conditions that apply to the Program. We will try to give you reasonable notice of any major updates and modifications to these Loyalty Membership T&Cs before they become effective, so that you have time to redeem your Points prior to the change if you do not agree with the changes. Your continued participation in the Program following any modifications will signify your acceptance of the revised terms. If you do not agree to any changes you should terminate your participation in the Program immediately.

We may make changes to the Program or these Loyalty Membership T&Cs even though such changes may affect a Member's ability to use Points already earned.

While it is our objective to make the Program accessible at all times, the Program and the Site may be unavailable from time to time for any reason including, without limitation, due to a service interruption or for routine maintenance. We will try to give you reasonable notice of any suspension or withdrawal of the Program or Site.

The Program and these Loyalty Membership T&Cs shall be governed by English law. You and Moroccanoil agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

Taxes may be payable on Rewards where required by law. Any tax liability or associated liability, including disclosure, is the sole responsibility of the Member.

Moroccanoil’s failure to exercise any of its rights under these Loyalty Membership T&Cs or its delay in enforcing or exercising any of those rights shall not constitute a waiver of such rights.

Moroccanoil may run promotions from time to time that provide enhanced benefits to select Members, which may be offered based on a Member’s loyalty tier.

If you have concerns that points from a Qualifying Purchase or other activity were not properly applied to your account, you should contact us by emailing contactus@moroccanoil.com. Your email must specify your name and email address associated with your membership of the Program, the date of the Program activity, and the issue you encountered.
